Terms of Use

These terms explain the rules for using ESTI. They include important limits on ESTI's responsibility and explain how disputes are handled.
1. Agreement to these terms
These Terms of Use ("Terms") are an agreement between you and ESTI, Inc., a California corporation ("ESTI", "we", "us" or "our"). They cover the ESTI website at www.esti.com, our emails and alerts, and ESTI when you use it inside an AI app (together, the "Service").
By using the Service, or by creating an account, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Who can use ESTI
You must be at least 18 years old and able to enter into a binding contract to use the Service.
If you use ESTI on behalf of a company or other organization, you agree to these Terms for that organization and confirm that you have the authority to do so.
3. What ESTI does
ESTI helps you look at homes for sale as possible fix-and-flip investments. For each home, ESTI shows estimates of renovation cost, after-repair value (ARV), profit and return on investment (ROI). These estimates are made by computer algorithms using data from third-party data providers, public records and listing sources.
ESTI is a research tool. ESTI is not acting as your real estate agent or broker, appraiser, home inspector, contractor, lender, or financial, tax or legal advisor.
4. Estimates are not advice
ESTI's numbers are estimates. They can be wrong, sometimes by a lot. They are not appraisals, inspections, offers, guarantees or financial advice, and they do not replace your own due diligence.
Actual renovation costs, sale prices, holding costs, profits and returns can be very different from what ESTI shows. Before you make an offer or invest, do your own research, inspect the property, and talk to qualified professionals such as an agent, contractor, appraiser, lender, accountant or attorney.

5. Property and listing data
Property details, listing information, photos and sales history come from third-party data providers, public records and listing sources. ESTI does not verify this information. It may be incomplete, out of date or wrong, and a home shown as for sale may already be under contract or sold.
Measurements and areas are approximate. Verify all information yourself before relying on it.
ESTI's estimates do not use Metrolist data.

6. Your account
You can browse some of ESTI without an account. To save homes, set up alerts and use other features, you need a free account. You can sign in with a link we email to you, with Google, or with other sign-in options we add. Some older accounts also have a password.
Please give us accurate information and keep it up to date. Keep access to your email and sign-in accounts secure, because anyone who can open your sign-in links can use your ESTI account. You are responsible for activity on your account.
Each account is for one person. Tell us right away at info@esti.com if you think someone has used your account without permission.
7. Free service and account limits
ESTI is free to use. To keep it free and fair, accounts have usage limits, such as how many homes you can analyze per day and how many homes you can save. Verifying your phone number by text message can raise your limits. We may change these limits at any time.
When you verify your phone number, we send you a text message with a code. Message and data rates may apply. We use your number for verification and account security, not for marketing texts.
If we ever offer paid features, we will tell you the price and terms first. You will not be charged unless you agree.
8. Showing requests and agent referrals
When you request a showing, you give us your name, phone number, preferred times and an optional note. At your request, we share these details with a partner real estate agent or broker, who may call or text you about that home and about related real estate services.
ESTI may receive a referral fee from the agent or broker, for example if you buy or sell a home with them. The fee is paid by the agent or broker. ESTI does not charge you for showing requests.
You do not have to work with the agent we connect you with, and you are free to choose any agent. Partner agents and brokers are independent businesses, not ESTI employees. Any agreement you make with them is between you and them, and ESTI is not responsible for their services.
9. Emails and alerts
We send emails you need to use the Service, such as sign-in links and messages about your account or these Terms. If you set up saved searches or alerts, we email you about matching homes. You can change or turn off alerts at any time.
We send marketing emails only if you opt in. You can turn them off in your Profile or with the unsubscribe link in any marketing email.
10. Using ESTI in AI apps
You can connect ESTI to AI apps such as Claude or ChatGPT by signing in to ESTI from the app. When you ask the AI app for ESTI information, we send it the estimates and property details you request.
The AI app is run by another company. That company's own terms and privacy policy apply to your use of its app. AI apps can summarize, change or misstate ESTI's numbers, and ESTI is not responsible for what an AI app says or does.
You can disconnect ESTI from an AI app at any time in that app's settings.
11. Acceptable use
You may use the Service for your own real estate research, including for your own investing business. You agree not to:
- Scrape, crawl or copy the Service, or access it with bots or other automated means, except through features we provide for that purpose (such as connecting ESTI to an AI app) or with our written permission.
- Copy, sell, resell, license, publish or redistribute ESTI's data or estimates, or use them to build a database, a competing product or a machine learning model.
- Get around account limits, for example by creating several accounts, or interfere with how the Service works.
- Try to break into, probe or disrupt the Service, or reverse engineer it, except where the law allows.
- Use the Service to discriminate in housing or to break any law, including fair housing, privacy and anti-spam laws.
- Submit false showing requests, pretend to be someone else, or harass agents, homeowners or other people.
We may limit, suspend or close access for anyone who breaks these rules.
12. ESTI's content and your license
The Service, including its software, design, text, estimates, and the ESTI name and logo, belongs to ESTI or our licensors and is protected by law. Property data is licensed to us by third parties and may be subject to their terms.
As long as you follow these Terms, we give you a limited, personal, non-exclusive, non-transferable license to use the Service for your own real estate research. We can end this license at any time. All rights not given to you here are reserved.
If you send us ideas or feedback, we may use them without paying you or owing you anything.
13. Your information
You keep any rights you have in the information you add to ESTI, such as notes, saved searches and deal defaults. You let us store and use it to run and improve the Service, as described in our Privacy Policy.
14. Other services and links
The Service uses and links to services run by other companies, such as maps and street imagery, sign-in providers, AI apps and agent websites. Their own terms apply, and ESTI is not responsible for them.
15. Changes to the Service
We are always improving ESTI. We may add, change or remove features, change account limits, or stop offering all or part of the Service at any time.
16. Ending your use
You can stop using ESTI at any time, and you can delete your account in your Profile.
We may suspend or close your account, or stop providing the Service to you, if you break these Terms, if we need to protect ESTI or other people, or if we stop offering the Service. Sections that by their nature should continue after your account ends will continue, including the sections on estimates, ownership, warranties, liability, indemnity and disputes.
17. No warranties
The Service, including all data and estimates, is provided "as is" and "as available". To the fullest extent the law allows, ESTI disclaims all warranties, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title and non-infringement.
We do not promise that the Service will be accurate, complete, current, uninterrupted, secure or free of errors.
18. Limitation of liability
To the fullest extent the law allows, ESTI and its officers, directors, employees, agents, licensors and data providers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, investment losses, lost data or lost business opportunities, arising from or related to the Service or these Terms, even if we were told such damages were possible.
To the fullest extent the law allows, ESTI's total liability for all claims related to the Service or these Terms is limited to one hundred US dollars ($100).
Some states do not allow some of these limits. In those states, these limits apply as far as the law allows.
19. Indemnity
If someone makes a claim against ESTI because of how you used the Service, your breach of these Terms or your breach of any law or the rights of others, you agree to defend and indemnify ESTI and hold it harmless from that claim, including reasonable legal fees, as far as the law allows.
20. Governing law
These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules, except that the Federal Arbitration Act governs the arbitration agreement in the next section.
Any claim that is not subject to arbitration will be decided only by the state or federal courts located in California, and you and ESTI agree to the personal jurisdiction of those courts.
21. Disputes and arbitration
Please read this section carefully. It affects your legal rights, including your right to go to court and to take part in a class action.
Talk to us first. Before starting arbitration or a court case, you and ESTI agree to try to resolve any dispute informally for at least 30 days. To start, send a written notice to info@esti.com with your name, the email address on your account, a description of the dispute and what you are asking for. We will send any notice to you at the email address on your account.
Agreement to arbitrate. If we cannot resolve the dispute informally, you and ESTI agree that any dispute, claim or controversy arising from or related to the Service or these Terms will be resolved by binding individual arbitration, not in court. This includes disputes about whether something must be arbitrated. The Federal Arbitration Act governs this agreement.
The arbitration will be run by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, which are available at adr.org. A single arbitrator will decide the dispute. The arbitration can take place by video, by phone, based on written submissions, or in person in the county where you live. The arbitrator can award the same individual relief a court could, but only for you individually.
Fees. Your share of the filing fee will not be more than the filing fee you would pay to start a case in court. ESTI will pay the rest of the AAA's filing, administration and arbitrator fees as the AAA Consumer Arbitration Rules require, unless the arbitrator finds your claim was frivolous or brought for an improper purpose.
Exceptions. Either of us may bring an individual claim in small claims court if it qualifies and stays there. Either of us may also ask a court for an injunction or other equitable relief to stop the misuse of intellectual property, or to stop scraping, automated access or other unauthorized use of the Service.
Class action and jury trial waiver. You and ESTI may bring claims against each other only individually, not as a plaintiff or class member in any class, collective, consolidated or representative proceeding. The arbitrator may not combine more than one person's claims. You and ESTI both give up the right to a jury trial.
Mass arbitration. If 25 or more similar demands for arbitration are filed against ESTI by or with the help of the same law firm or group, the AAA will handle them in batches of up to 50 demands, with one arbitrator for each batch, and fees will be charged per batch. Only one batch will proceed at a time unless both sides agree otherwise. You and ESTI agree to work in good faith on this process, and the statute of limitations is paused for each demand until its batch is heard.
Opting out. You can opt out of this arbitration agreement by emailing info@esti.com within 30 days after you first agree to these Terms. Include your name, the email address on your account and a clear statement that you want to opt out of arbitration. Opting out does not affect any other part of these Terms.
If part of this section is unenforceable. If the class action waiver is found unenforceable for a claim, that claim (and only that claim) will be decided in court, not arbitration, and the rest of this section still applies. If any other part of this section is found unenforceable, the rest of it still applies.
Changes to this section. If we change this section in the future, the change will not apply to a dispute we already knew about before the change.
22. Notice for California users
Under California Civil Code Section 1789.3, California users are entitled to the following notice: the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs can be reached in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
23. General terms
These Terms, together with our Privacy Policy and Disclaimer, are the whole agreement between you and ESTI about the Service. If a court finds part of these Terms unenforceable, the rest stays in effect. If we do not enforce a part of these Terms, that is not a waiver. You may not transfer your rights under these Terms; we may transfer ours, for example as part of a merger or sale. Nothing in these Terms creates a partnership, employment or agency relationship.
24. Changes to these Terms
We may update these Terms from time to time. We will post the new version on this page and change the "Last updated" date. If a change is important, we will also tell you, for example by email or with a notice on the site. If you keep using the Service after the changes take effect, you accept the updated Terms.
